1. Definitions

In these terms: "fonkle." or "we" refers to the company operating the website fonkle.com and providing the service. "Customer" or "you" refers to the natural person placing an order via the website. "Book" means the personalised children's book generated, printed and delivered by fonkle. "Service" means the website through which customers can create and order personalised children's books.

2. Applicability

These terms apply to every offer by fonkle. and to every agreement concluded via the website. By placing an order you agree to these terms. Any terms or conditions of the customer are expressly rejected.

3. The product

fonkle. offers personalised children's books based on the photos, names and choices you provide. The book is automatically generated using AI technology (for story and illustrations) and printed and delivered by an external print partner. AI-generated content may vary and is not identically reproducible.

4. Formation of the agreement

The agreement is formed when you complete your order and payment is confirmed by Stripe. You will receive a confirmation email. fonkle. reserves the right to refuse an order if there are reasonable grounds to suspect misuse.

5. Price and payment

All prices on the website are in euros and include VAT. The total price including shipping costs is shown before you complete your order. Payment is processed via Stripe (iDEAL, credit card or other available payment methods). Your order will only go into production after payment has been received in full.

6. Right of withdrawal

Because each book is uniquely custom-made based on your personal photos and choices, it falls under the legal exception to the right of withdrawal for custom-made products (Article 6:230p paragraph 1 sub c of the Dutch Civil Code). At checkout you expressly agree to this and waive your right of withdrawal.

This means an order is final once payment is made: it cannot be cancelled, changed or returned. Please check your details, photos and the full preview carefully before you pay.

7. Delivery

After payment your book is printed by an external print partner and then shipped. The total delivery time depends on the chosen shipping option and the delivery address and is shown as an indication at checkout; this indication covers both production and shipping. All stated delivery times are estimates and expressly not binding. Due to busy periods, weekends, public holidays, customs or carrier delays the actual delivery time may be longer. A longer delivery time does not entitle you to cancellation, a discount or compensation.

Risk of the product transfers to you upon delivery. In case of loss or damage during transit, we will contact the carrier and arrange a replacement where applicable.

8. Conformity and complaints

If your book arrives damaged or the print quality materially deviates from what can reasonably be expected, we will send a new copy free of charge. Report this within 14 days of receipt via [email protected] with photos of the issue. Complaints about AI-generated content (story, illustrations) are not covered, as you are shown a full preview before checkout. Placing the order constitutes acceptance of the preview shown.

9. Intellectual property

The photos you upload remain your property. The generated book (story and illustrations) may be freely used for personal, non-commercial purposes. Commercial use, resale or reproduction of the book or illustrations is not permitted without written consent from fonkle.

10. Liability

The liability of fonkle. is limited to the amount paid for the order in question. fonkle. is not liable for indirect or consequential damages, including but not limited to missed events due to late delivery. This limitation does not apply to damage caused by intent or gross negligence.

11. Applicable law and disputes

These terms and all agreements are governed by Dutch law. Disputes will be submitted to the competent court in the district of the consumer's place of residence, unless mandatory law dictates otherwise.
